Terms of Service

These Terms of Service (“Terms”) govern your use of the StayConnected mobile application and related services (“the Service”) provided by The Aviary Labs (“we”, “us”, or “our”), based in Burwood, Christchurch, New Zealand. By creating an account or using the Service you agree to these Terms.

1. Eligibility and account

You must be old enough to form a binding contract in your jurisdiction (16 in New Zealand and the EU, 13 in the United States). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms.

3. Your content

You retain all rights to the data you enter into the Service (“Your Content”). You grant us a limited licence to host, store, process, and transmit Your Content as necessary to provide the Service — for example, syncing your contact records across your devices and generating conversation suggestions when you ask for them. How Your Content is stored and protected is described in our Privacy Policy.

You are responsible for the lawfulness of Your Content. You must have the right to record information about the contacts you store, and you must comply with applicable privacy laws when doing so.

4. AI-generated suggestions

When you use the conversation-starter feature, suggestions are generated by a third-party AI model (Google Gemini). AI output may be inaccurate, biased, or inappropriate. You are responsible for reviewing any suggestion before acting on it. We make no warranty as to the accuracy or suitability of AI-generated content.

5. Acceptable use

You agree not to:

• Use the Service to harass, defame, stalk, or harm another person.
• Store information about a contact in violation of applicable privacy laws.
• Reverse engineer the Service except to the extent permitted by law.
• Interfere with the security or integrity of the Service.

We may suspend or terminate accounts that violate these rules.

6. Service availability

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Features may change, be added, or be removed.

7. Disclaimer and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, The Aviary Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

8. Termination

You can delete your account at any time from within the App. We may suspend or terminate your account for violation of these Terms or for legal reasons.

9. Changes to these Terms

We may update these Terms from time to time. The effective date above will be revised when changes are made. We will notify you in-app of material changes before they take effect. Continued use of the Service after a change indicates acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
