Terms of Service

These Terms of Service (“Terms”) govern your use of the Sleep Little Finch mobile application (“the App”) provided by The Aviary Labs (“we”, “us”, or “our”), based in Burwood, Christchurch, New Zealand. By installing or using the App you agree to these Terms.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use.

2. Not medical advice

Sleep Little Finch is a tracking and reminder tool. It does not provide medical, paediatric, or professional advice. Information in the App is for general informational purposes only and is not a substitute for advice from a qualified healthcare professional. Always consult your doctor, midwife, or paediatrician for concerns about your child’s health, sleep, or development.

3. Your data

You are responsible for the data you enter into the App. Because the App stores your data locally on your device, backing up that data is your responsibility. Uninstalling the App will permanently delete all locally stored data.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.
• Use the App in a way that violates any law or the rights of any third party.
• Modify, distribute, or create derivative works of the App.

5. Disclaimer and limitation of liability

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, The Aviary Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App.

6. Changes to the App or these Terms

We may update the App and these Terms from time to time. The effective date above will be revised when changes are made. Continued use of the App after a change indicates acceptance of the updated Terms.

7. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
